To raise $5000 towards legal costs to defend a high court appeal from MBIE against the recent Bell Appeal decision

Jeff Bell won an appeal against a LBP complaint decision. This was with generous assistance of a previous 'givealttle' page. MBIE and the Building Practitioners Board have lodged an appeal in the high court seeking to overturn the appeal.
After the Bell appeal hearing and before the judges decision was made MBIE provided the Kumar vs Ali decision to the court. This Kumar decision used arguments that had not featured in the Bell appeal and were not argued by his advisors. The Bell decision was good for the other arguments that were run (e/g/recognition of schedule 1 work as not RBW)but the Kumar precedent was used by the judge as his main reason to overturn the BPB decision'.
MBIE are now seeking to overturn the Kumar vs Ali precedent despite not appealing it when it first came out in the Kumar appeal decision. That Kumar decision stated that it was the owners responsibility to advise the council when a LBP left the site and institute a new LBP who would provide a ROW. This is contrary to many previous BPB decisions where LBP's who had left in disputes were still found liable for the failure to provide their ROW (often because they were distracted by the dispute and anyway no one asked for it(including council who often prompt the LBP.
Long story short is that we are seeking contribution to legal costs ($5000) to allow a proper defence and ensure the gains made by Kummar and the Bell appeals are not lost.
I have given Jeff building consultant advise in the course of the complaint to the LBP board.He appealed the decision and won his appeal with the help pf a givealittle page which raised 8000+. Unfortunately the LBP Board appealed the decision to the high court. We now need to raise $5000 to fund this defense of that appeal expected in may June.
All funds will be forwarded to legal counsel for Jeff Bell's legal costs. If a surplus should occur funds will be held in trust for the use of a similar situation involving an LBP complaint.

Your generous donation was intended to provide resource to mount arguments to protect the Kumar decision. Because of time frames and to some extent a failure to get enough support the defense we wanted to run was not possible and the threat of costs was a concern.
long story short is that the money is still held by us in trust.
Our barrister does not feel that he can call on this as the reasons for the give a little appeal have not been satisfied in our view.
He is having to continue support for Jeff at the BPB as they have decided to rehear the complaint in respect to the allegation of RBW and lack of ROW. We have the argument that work was not RBW as under schedule 1 and therefore ROW was not applicable.
I am offering to refund the donations in full or if you indicate I would like to ask permission to forward the money to set against the legal costs to date and continuing.
I am personally not receiving any remuneration in this LBP matter.
