Lynn has suffered enough and the last straw was loosing her vehicle that no one seems to be responsible for
Waikato
In May this year a young lady driving home from work lost control of her vehicle and smashed into Lynn's car that was parked off the road on our property ( where Lynn rents our granny-flat) Lynn's husband died last year and since then has been trying to get her life back on track. She has had to go back to school to redo her nursing degree as this had lapsed and she couldn't get any employment of any type. As a result of not having a job the insurance on her car had lapsed but she had it parked up safely behind the trees on our property (or so we thought). My insurance wouldn't cover her car so Lynn contacted the girl but as she didn't wear her seat belt and was injured and no insurance. As a result Lynn took her to tribunal hoping that she would be told that as she was driving a vehicle and caused damage would have to pay for the car but NZ law states unless Lynn can prove she drove negligently their is no case and left it up to the girl and her family to pay some sort of compensation. Alas they have decided to go the no responsibility for my actions route and therefore has left my lovely friend high and dry.
I am Lyn's friend, she lives in my grannyflat and on 17th May this year a girl lost control of her car and crashed into our property causing damage to Lyn's car. Her car has been written off and she had to let the insurance lapse as on the benefit and just didn't have any spare money.
