    OPERATION SINATRA SURVIVOR HONORARIUM

    Terms of Use

    1. HONORARIUM

    1.1 The Operation Sinatra Survivor Honorarium (Honorarium) has been established to support Applicants (as described in clause 2 below) associated with Operation Sinatra, being the police criminal investigation launched in July 2018 and subsequent court proceedings, resulting in the conviction of two individuals in respect of crimes committed by them against women at hospitality venues in Christchurch (Operation Sinatra).

    1.2 The Honorarium is separate to, and not affiliated with, any Ministry of Justice compensation paid to victims of crime.

    1.3 All donations to the Honorarium made through the crowdfunding campaign run on Give a Little will be used solely for the purposes set out in these terms and are non-refundable.

    1.4 The trustee of the Honorarium reserves the right to refuse any donation.

    2. APPLICANT

    2.1 An Applicant is a person:

    (a) against whom a crime had been committed by one or more of the convicted perpetrators associated with Operation Sinatra; and

    (b) who had charges proceeded with before the Courts in connection with Operation Sinatra (in either of the two trials),

    as verified by New Zealand Police Ngā Pirihimana O Aotearoa (NZ Police).

    2.2 An Applicant excludes:

    (a) a witness of events associated with Operation Sinatra;

    (b) a family or whānau member of an Applicant; and

    (c) any other person who does not meet the strict definition of an Applicant.

    3. HONORARIUM ALLOCATION

    3.1 Subject to complying with the application process in clause 5, each Applicant will be entitled to an equal (1/31) share of the Honorarium (Honorarium Allocation).

    4. HONORARIUM ADMINISTRATION

    4.1 The Honorarium will be paid into a trust account operated by law firm Buddle Findlay (Buddle Findlay).

    4.2 The purpose of depositing the Honorarium into a reputable law firm's trust account is to ensure the Applicants' anonymity and to provide confidence that all donations to the Honorarium through Give a Little will be distributed to the Applicants in accordance with these terms.

    4.3 Buddle Findlay will administer and distribute the Honorarium to the Applicants in accordance with these terms.

    5. APPLICATION PROCESS

    5.1 NZ Police will email the Applicants:

    (a) notifying them that the Honorarium and the Give a Little page for the Honorarium have been established;

    (b) attaching a copy of:

    (i) these terms; and

    (ii) the form (Application Form) in which the Applicants elect whether they wish to receive their Honorarium Allocation and, if they do, provide details of a bank account held in their name and their contact details;

    (c) providing the contact details of the lawyer at Buddle Findlay (Honorarium Liaison) to whom the Applicants will provide their completed Application Forms; and

    (d) setting out an appropriate date and time by which the Applicants will need to submit their Application Form to the Honorarium Liaison and respond as to whether they elect to receive their Honorarium Allocation, as reasonably determined by the Honorarium Liaison (Response Date).

    5.2 To be eligible to receive their Honorarium Allocation, an Applicant must fully complete and email the Application Form to the Honorarium Liaison on or before the Response Date.

    5.3 An Applicant can elect in the Application Form for their Honorarium Allocation to be split equally between all Applicants who have elected to receive their Honorarium Allocations and submitted Compliant Application Forms (Remaining Applicants). An Applicant's Honorarium Allocation that is to be split equally between Remaining Applicants under this clause 5.3 will be referred to as an Applicant Donation. Each Remaining Applicant's share of an Applicant Donation will be referred to as an Applicant Donation Allocation.

    5.4 The Honorarium Liaison will determine at their absolute discretion whether an Application Form has been received by the Honorarium Liaison by the Response Date (On Time Application Forms).

    5.5 If an Applicant's Application Form is not received by the Honorarium Liaison by the Response Date, this will be deemed to be an instruction by the Applicant to the Honorarium Liaison for the Honorarium Liaison to deal with that Applicant's Honorarium Allocation as an Applicant Donation under clause 5.3.

    5.6 After the Response Date, the Honorarium Liaison will email NZ Police the On Time Application Forms.

    5.7 An On Time Application Form will be verified as compliant if the:

    (a) NZ Police verify and confirm to the Honorarium Liaison that the On Time Application Form relates to an Applicant;

    (b) Honorarium Liaison confirms that the On Time Application Form contains all the details required in the Application Form to enable the Honorarium Liaison to distribute the Honorarium Allocation to the relevant Applicant; and

    (c) Applicant submits their identity and contact details as contained in their Application Form for verification through Buddle Findlay's electronic verification system called APLYiD (which is completed via smart phone - full information about the APLYiD process is outlined here) and their identity and contact details are verified as correct,

    (Compliant Application Form).

    5.8 Within 10 working days of the verification in clause 5.7 or soon after, the Honorarium Liaison will pay to each Applicant that has provided a Compliant Application Form and wishes to receive their Honorarium Allocation, an Honorarium Allocation and any Applicant Donation Allocation, provided that if an Applicant has a Compliant Application Form and wishes to receive their Honorarium Allocation but has died before receiving their Honorarium Allocation, then their Honorarium Allocation and their Applicant Donation Allocation shall be paid to their Next of Kin (as defined in clause 8.1), if there is more than one Next of Kin in equal shares.

    6. PRIVACY

    6.1 In submitting a completed Application Form and undertaking the Applicant verification process through the APLYiD process under clause 5, an Applicant will provide personal information about the Applicant (Applicant Information) to the Honorarium Liaison, Buddle Findlay and NZ Police.

    6.2 Applicant Information collected through the Application Form and the APLYiD process will be held, stored and processed by the Honorarium Liaison, Buddle Findlay and NZ Police to enable:

    (a) the Honorarium Liaison and Buddle Findlay to:

    (i) contact the Applicants, if required;

    (ii) verify the identity and contact details of the Applicants; and

    (iii) administer and distribute the Honorarium (including any Applicant Donations), as described in these terms; and

    (b) NZ Police to carry out the verification process referred to in clause 5.7(a).

    6.3 If an Applicant does not provide the necessary Applicant Information to complete the Application Form or the Applicant verification process through the APLYiD process, the Honorarium Liaison, Buddle Findlay and NZ Police will be unable to carry out the activities referred to in clause 6.2 and the Applicant may not be paid the Honorarium Allocation and any Applicant Donation Allocation.

    6.4 Applicants are entitled at any time to access their Applicant Information and correct any errors in the Applicant Information.

    6.5 The Honorarium Liaison, Buddle Findlay and NZ Police will not keep Applicant Information for longer than is required for the purposes referred to in clause 6.2 or as required by law, which ever is later.

    6.6 All details about the Applicants (including the Applicant Information) and the Honorarium disbursement will remain strictly confidential between Buddle Findlay, NZ Police and the Applicant and will not be disclosed to any third party.

    6.7 The Honorarium Liaison and Buddle Findlay will only disclose to the media the following information which will not identify any Applicant:

    (a) total Application Forms received by the Honorarium Liaison;

    (b) total Honorarium Allocations received by Applicants; and

    (c) total Applicant Donations.

    7. NO LIABILITY

    7.1 Neither the Honorarium, the Honorarium Liaison, Buddle Findlay nor NZ Police is liable in any way to any Applicant or any other person for any loss or damage suffered or incurred in connection with the establishment of the Honorarium, any errors, inaccuracies or omissions on the Give a Little page, the collection of donations, any unauthorised disclosure of Applicant Information and the administration or distribution of the Honorarium (including without limitation, if an Applicant's Application Form is not received, is deemed to have been received after the Response Date, or is deemed to not be a Compliant Application Form, or the Applicant's Honorarium Allocation is dealt with as an Application Donation).

    8. NEXT OF KIN

    8.1 Next of Kin means the following people in connection with an Applicant that has died:

    (a) the surviving spouse or civil union partner or de facto partner of the deceased;

    (b) if there is no person eligible pursuant to clause 8.1(a), then the biological children of the deceased;

    (c) if there is no person(s) eligible pursuant to clauses 8.1(a) and 8.1(b), then the biological parents of the deceased;

    (d) if there are no person(s) eligible pursuant to clauses 8.1(a), 8.1(b) and 8.1(c), then the biological brothers and sisters of the deceased; and

    (e) if there are no person(s) eligible pursuant to clauses 8.1(a), 8.1(b), 8.1(c) and 8.1(d), then all surviving Remaining Applicants referred to in clause 5.3.

      Wishing fellow survivors all the very best for your futures! Stay strong and proud! Just know there are lots of people you didn't even meet that you went through this process for. You've given a voice to those who were silenced.
