  • An Ultimately Positive Outcome

    The High Court ruled the Environment Court’s decision to allow the demolition of 22 Crescent Road, Epsom should not be taken as precedent.

    Justice Muir, who’s retirement was announced with “thanks [for his] outstanding contribution to the judiciary and to the administration of justice” by the Chief Justice just four days later, made clear distinctions:

    “The effect of the decision is not to licence demolition in any case where a proposed replacement building makes a positive contribution to streetscape character.” … “Even an architecturally outstanding new building may not justify demolition of an existing building which makes a significant contribution to the special character values of an area.” … “A well designed new building that would be appropriate in one special character area might be inappropriate in another due to different identified character values. Even a building of modest individual architectural merit may warrant retention due to a critical contribution to an important group of buildings.”

    Character Coalition believes this High Court ruling means future applications to demolish homes in Special Character Areas, citing the Crescent Road Environment Court decision, may be warded off.

    Unfortunately, the decision to demolish the Crescent Road property was allowed to stand as being within the discretion of the Environment Court.

  • Fundraising Success

    Thank you to the many generous Aucklanders who supported the Art Auction & Market Day on Saturday March the 1st. Thanks especially to Historic Places Auckland and John Kinder House for hosting the event so proficiently. The fundraising result was rewarding and much needed as the appeal heads to the High Court in Auckland today, Tuesday March 11.

    The legal appeal against the Crescent Road planning decision is a public hearing so anyone is welcome to attend and witness.

    Thank you to all who are continuing to donate here at this Givealittle page. You are supporting this very important effort to turn back a devastating planning precedent, not just for this Special Character area in Epsom, but for Special Character areas city-wide.

  • Art Auction & Market Day

    Character Coalition, members Historic Places Auckland and John Kinder House are joining forces in organising a wonderful picnic day on 11am to 2pm on Saturday March 1st at John Kinder House, 2 Ayr Street Parnell.

    Bring a picnic and an item to be auctioned as entry cost to raise money for our High Court Appeal. Suggested items are pottery, china, kitchen ware, jewellery, paintings, curios, (no electrical items). Sign-posted carparking is available next door at 470 Parnell Road, back of the Bellingham & Wallace Building.

  • A Lot at Stake

    The stakes are high; if the ruling of the Environment Court regarding Crescent Road is allowed to stand, every home in every Special Character Area in Auckland is threatened. The consequences could be like those already wrecked on the pictured Sholto Smith “Art and Crafts” home at 37 Upland Road in 2022.

    The Character Coalition is represented in its appeal to the High Court by Bronwyn Carruthers KC, who also represented the residents at the Environment Court. Carruthers KC’s advice is that there are errors of law in the Environment Court's decision, and she has laid out the grounds for appeal. The High Court has set the appeal date down for a hearing on 11 March 2025 with submissions due to be filed by 29 November 2024.

    The costs of the appeal must be paid by Character Coalition as appellant, and the residents who have already spent considerable funds on the Environment Court hearing. These funds must be raised, or we will not be able to continue with the legal appeal.

    Because this is a matter affecting every home in every Special Character Area in Auckland, we are asking each of Character Coalition’s member groups to contribute towards these costs. Thank you to the generous donors who have also given directly to Character Coalition. Every dollar counts. Collectively we can stand up for our Special Character Areas in the face of this very real threat.
