    Just an update to let you know some of your help is going to help the Hikoi of a Poisoned Nation which we hope you are all following on Facebook.

    Some of us have walked with the southern leg of the Hikoi (click on videos on Hikoi Facebook and you will see us there) and chairman of Te Whare Dan is now in Auckland busily handing out leaflets to boost support among the locals and get them out there to walk the Auckland Harbour Bridge this coming Sunday. Our good friend Emille needs support and we need a good showing here, with impending drops in many places now including the Hunua Ranges - Auckland's water supply.

    Hope some of you can get out there and do some walking or at least share the Hikoi Facebook to as many people as you can and use #ban1080 and #hikoiofapoisonednation

    Well, many of you may have heard the judgement made in the High Court in Wellington a few weeks ago against the Brook Valley Community group and Te Whare. The court case lasted for and day and a half, with our two lawyers (Brook lawyer Sue Grey and our own Alan Tobeck) up against 8 others - 2 each from the Ministry for the Environment; Nelson City Council, Brook-Waimarama Sanctuary and Forest and Bird.

    Sue did a wonderful job, arguing for hours why the area should not have 26 tons of Brodificoum poison dropped aerially. As an ‘intervener’ to the case, Alan was permitted only 20 mins, then a further 3, to argue why the Exemptions to the Resource Management Act introduced earlier this year are unfair, citing the fact that there is now no need for consultation or even notification before an aerial poison drop. He also pointed out the lack of pre and post monitoring to show success or otherwise of these operations. None of our affidavit evidence was heard in court. The Judge was purely looking for a question of law and made his rushed judgement against the Community group and ourselves in order for the drop to carry on as scheduled.

    We believe there are flaws in this decision and have supported Sue Grey in her formulation of an appeal. They will again, however, ask for Security of Costs to hear the appeal (their lawyers recently requested that this be over $42,000!).

    The good news is that the garnishee order case against Te Whare has been dropped so we still have nearly $15,000 of your donations in our solicitor’s Trust account. We said in the beginning that those of you who donated $500 or more would be offered back their donation if it was not needed for Security for Costs in our original court case. This we do here and now.

    However, we would urge you to leave your money in Te Whare for ongoing court battles. We are not giving up!

    Meanwhile, our chairman Dan has been following the poisoners around again with his video camera – to the ZIP drop in Arawhata – where baits were laid directly into the river (filmed trout swimming around them) despite DOC warning concession holders, a mere 2 days prior, that baits would not be put in the river.

    ZIP is the latest non-government organisation to be spreading 1080. It is an incorporated society funded by Gareth Morgan and others including several dairy companies. As such it is not subject to the Official Information Act and is now refusing to give Dan any data of post drop monitoring of pests etc (as usual there was no pre-monitoring, so therefore no basis to determine if the double dose of 1080 given was even necessary) simply because he was on site asking questions about the legality of the road closure when DoC was conducting the operation.

    If any of you have time you could help by asking ZIP CEO Al Bramley for stats on what they found left in the area after the drop to justify the second dumping of 1080 over the same area. This is all part of the Predator Free ethos which means double blitzing everything on a landscape scale.

    Dan and a few others also protested at the loading site for the Barrytown Coast Rd drop where the 1080 dust was pungent in the air, yet locals were not offered alternative water...

    Just more evidence of the lack of care that the government has for the people it governs...

    But with your help we are determined to stick up for the rights of the people and the animals and plants of this land through more court action.

  • ALL IS NOT LOST...

    Hi Supporters,

    Good News...Today we are back in court.

    Te Whare has joined in with some legal action which was started by Brooke Valley Community Group Inc in Nelson to stop a planned drop of Brodificoum in the Brooke Waimarama Sanctuary.

    We are challenging the very crux of the recently introduced Resource Management Regulations which exempted the need for a Resource Consent (with no need for consultation or notification) on poison operations such as this.

    We are drawing 1080 into this argument and our lawyer, Alan Tobeck, is also representing two other anti-1080 groups, the Wildlands Biodiversity Management Society and Farmers Against Ten Eighty.

    The case is a big one and starts today in the High Court in Wellington.

    So if you live in the area and are able to come along to listen we really need BUMS ON SEATS to show support (rather than protest action) as TV3 and a documentary maker will be there.

    We have used some of the money you donated to fly to and accommodate in Wellington Mr Tobeck and our chairperson, Dan Lane, so thanks again for your donations.

    Hope you can make it there - if not - watch this space (and TV3 news)...

  • Result of Appeal

    The final court decision did not arrive until the 14th of Feb and unfortunately the news is not good.

    Our High Court appeal against the Environment Court decision to strike out proceedings (not allow the case to be heard) was denied by Judge Nicholas Davidson in a 19 page decision - not all of which we fully understand, as it's in legal-speak. Since then we have been waiting to meet with our lawyer, when he can make it up from Southland to the West Coast, to go through it with us and discuss how we can take things forward. We've spent the last 6 years on this case and have put thousands of hours of work into it, and a lot of our own money (thousands of dollars spent on photocopying alone) - so, needless to say, we are more than a little disappointed.

    The judge basically denied the appeal on the grounds that there were procedural deficiencies (before we got our lawyer) and that we did not have the full amount of Security for Costs when the original decision against us was made (though we had it by the time the appeal case was heard).

    He did make an "observation" right at the end of his conclusion, however, saying:

    " Aside from declaratory relief Te Whare’s concerns may take other lawful courses. This observation is made to recognise the underlying concern for the public good which founded this litigation"

    What these other lawful courses are is what we need to discuss with our lawyer. It could involve private prosecution.

    As for the money donated through Givealittle - that (bar $1600 for the application to court for appeal) remains in our solicitor's Trust Account. Unfortunately the opposition has now put a Garneshee Order on that money - trying to take it from us (and you) to pay for court costs that have been awarded against us. We are going to court again over this (no date yet set), since you have given this money for a specific reason (Security for Costs) and we believe they have no legal right to freeze and take money from a lawyer's Trust Account in this way.

    If we are successful in court over the Garnishee Order we will return your donations to you now that the $15,000 Security for Costs is not needed.

    We apologise to you for the delay in reporting the final outcome of a few weeks ago - we are still feeling somewhat stunned and bewildered, plus I have been away.

    Was hoping to give better news than this, but unfortunately that was not to be.

    We take a little solace in the fact that it took the judge 5 months to make the decision (obviously not a clearcut one) and that we have been a thorn in the side for the 1080 poisoners AHB, DoC and West Coast Regional Council for the past 5 years.

  • Latest Court News

    At the High Court in Chch last week a reserved decision was made by the judge. About half a dozen supporters turned up which was a great boost for us. The judge commented to the audience that he was impressed with our lawyer's representation. He also said that there could be other ways of going about this all, though we feel as though we have exhausted other avenues. He asked for additional info from our lawyer which has now been provided. We do not expect a decision until the end of September and will let you know the outcome when we hear. Thanks again for your support.

  • High Court Appeal next week

    Thanks to all the new donors (and again to the old) - We have now reached the target of $15, 000!

    This was to pay Security for Costs for the remaining 3 entities (DOC, AHB and WCRC) we still hope to take to the Environment Court.

    But first we have to win an appeal against strike-out.

    This appeal will take place in the High Court in Christchurch (282 Durham St) at 10 am on Wed the 31st Aug.

    The proceedings may be a little mundane (discussing what was said in the last hearing) but we urge anyone who can to come along and support our team: Dan Lane (our chairperson), Phil Paterson (originator of court action and gatherer of the 23 affidavits of witnesses to 1080 consent breaches on the West Coast) and our lawyer Alan Tobeck.

    We want to show the judge that they are not alone but are representing others so if you can come give moral support that would be fantastic.

    $1600 of your donations had to be used just to have this appeal heard against the same Environment Court judge we won against last time in the High Court in Greymouth... so we'd love to see you there.

  • Crunch time soon

    Thanks to everyone who has been donating lately - it has been a real boost, both for the money and the morale. A few people who don't do internet banking have sent us cheques through the mail - if you know anyone who has done this please pass on our thanks to them as well. These cheques (a couple of hundred worth) have been deposited straight to our bank account.

    Our lawyer's next appearance before a judge is on the 11th of July. This is an Interlocutory occasion - where they decide if it is worth taking our appeal to the High Court. We are awaiting a transcript of the previous decision so that we can show there were some misinterpretations in the judge's decision of what was discussed on the day.

    It would be great if we could turn up on the 11th with the full $15,000 required for security of costs so that we can show it is not "too little, too late" as the Judge stated. So if you know anyone else out there who is keen to help a little to knock out that last $1000 or so that would be brilliant.

  • Good news/bad news

    Well, the good news is that the Environmental Legal Assistance fund (ELA) has given Te Whare $5000 to pay for our lawyer Alan Tobeck from Southland.

    The bad news, however, is that after our win against strike-out in the High Court the case was sent back to the Environment Court before the same judge who had originally struck us out, Judge Newhook, who ruled again that the case should not be heard. He stated that the case was stale and that it was costing the opposition a lot and that we did not have enough money to cover the Security for Costs.

    Prior to the hearing we had dropped two of the five respondents (the helicopter pilot and EPRO contractors), leaving in DOC, AHB and the West Coast Regional Council. We hoped that that would reduce the amount of Security to $15,000 and as you beautiful people had donated over $11,000 we were prepared to go into debt to make up the shortfall ourselves to get it heard in court.

    Thus we have lodged another appeal with the High Court - it is not over yet - so watch this space...

    And thanks again to all those who have donated even a small amount as it all adds up and hopefully we can still get the 15k and have our voices heard in court.

  • The Next Step

    The Judge in November's High Court hearing has directed our lawyer to confer with the opposition's lawyers and file a joint memorandum by the 27th of Jan.

    Meanwhile...we have had some amazing donations from you people and having got over the $5000 mark means that we should, at least, be able to take one of the parties to court - DoC or West Coast Regional Council are top of the list. It would be great to make it to $10,000 before the 27th so that we could include both of these. Even better if we could get more and include some of the other parties too. Donations have stalled a bit lately so don't forget to tell your friends...(surely there are more than 96 people out there against this stuff).

    On 5th Nov we had an appeal heard in the High Court in Greymouth where our lawyer did exceptionally well (he has only just joined our fight - we previously represented ourselves) and saved the case from being struck out. So it will now go back to the Environment Court where the $25,000 will be asked for so as to continue any further.
