Do you believe you have a right to refuse medical treatment? Now is the time to act.

  • Finish line in sight! Thank you for all your support. What's next?

    Dear supporter,

Due to the expert work of Frontline Law we've our original anticipated legal costs have been reduced and we are comfortable to say we have enough funds through our give-a-little page and NZTSOS account to get us to 'the finish line.' Thank you so much for your support.

We have been allocated some time in the Court of Appeal in August/September 2023 although we may be able to get there earlier. We hope to get an update on that this month.

We have/are closing this give-a-little fundraising drive but we still have some financial needs. For example; you can now go to our website www.nztsos.org. This cost approximately $1,500 to set up.

We are setting up a much needed information pack with info on law relating to discrimination in the context of vaccination issues, employment rights and obligations, advice for people applying for jobs, a summary of the work NZTSOS has done and is doing and avenues for further support. This will cost $1,000 - $2,000 to set up.

We are involved in a legal dispute arising from information we gathered for our affidavits in the original court case. We need $2,000 to help with this.

If you are able to help with any of these needs, please contact us on office@nztsos.org.

The best way to follow our progress and keep up to date is through www.nztsos.org

    Once again, thanks

  • Appeal Case is Extremely Important even though the Covid-19 traffic system has been scrapped.

      15 September 2022

The Covid-19 Protection Framework ended at 11.59pm on Monday. But employers are still able to discriminate in the work place based on how many injections workers have received.

This is why we want to thank you for your support of the appeal. It is important to hold our government to account.

We also want to thank Frontline Law in their relentless pursuit of justice. Aly Miller (pictured) has prepared the case file expertly in the diligent fashion that has kept the costs down.

The next stage now is to prepare the actual arguments that will show the Court of Appeal judges that the High Court got its ruling wrong.

Once again thank you for continued support.

  • A one day hearing has been allocated in the Court of Appeal!

      2 September 2022

Our appeal has been allocated a 1 day hearing before the Permanent Court by his Honour Justice Goddard. The Permanent Court is the Court of Appeal made up of three judges, usually all permanent members of the court.

Justice Goddard says, “Currently I am allocating Permanent Court fixtures into August and September 2023, however I anticipate earlier dates may become available in the coming months as the roster is finalised. At this juncture I don’t propose to allocate a hearing date and will be in touch [with our lawyer] in a month’s time with an update.”

This is a delay, however it does give a lot more time to educate the general public on human rights issues, the reason for the appeal and to make gains in the court of public opinion. And of course more time to continue fundraising for our legal costs. We have raised $25,000 toward a maximum expected cost of $50,000. Some of that is here on give a little and some through our other fundraising. Please consider doing a top up donation and/or sharing on your social media or email.

    Thanks a lot,

    Mike Shaw - Spokesperson NZTSOS

  • Excited to have Matthew Hague from Frontline Law in our corner!

      28 July 2022

We have engaged Matthew Hague to present our Appeal! You may recall that just before the teachers and doctors went to court to challenge the lawfulness of the vaccine mandates, the police and NZDF won their case and had their mandates overturned on three counts. Matthew Hague led that legal challenge and won! So this is a hugely significant development to now have Matthew taking our case to Court of Appeal! Please spread the word that teachers are fighting for the rights of all New Zealanders and need the support of all people who value human rights.

  • Reduction in costs and getting nearer to our goal!

      27 July 2022

You may have noticed that we have reduced our fundraising target by a considerable amount! This is because of an exciting new development which once we have formalised, we will look forward to sharing with you. We believe it will increase the momentum and profile of this exciting case.

Justice Cooke decided that the Right to Refuse to Undergo Medical Treatment for the healthcare and education workers was not absolute, and that it was “reasonable and demonstrably justified” in “a free and democratic society” for the government to override it, by mandating those in the healthcare and education professions to be vaccinated. Given the limited evidence put forward by the government and the extensive independent expert evidence put forward by the healthcare and education workers, we believe the court has set a very low bar for overriding this fundamental right.

NZTSOS is now in the process of appealing this decision. This means it goes before the court again, but this time in front of a team of judges who will review Justice Cooke’s decision.”

  • Application for Hearing Date

      13 July 2022
    Main image

"We are excited! Today we instructed our solicitors McKenna King to put together the case of appeal and apply for a hearing date. There are four specific grounds of appeal. The first being that the High Court erred in law when determining that the right to refuse medical treatment under s 11 of the New Zealand Bill of Right Act 1990 ('the right') was not absolute.

Would you share our appeal on your social media platforms and by email? All you have to do is click on the link and then hit the share button!

As appellants we seek the following judgement from the Court of Appeal: That the appeal be allowed, that the High Court's judgement be reversed and the COVID-19 Health Response (Vaccinations) Order 2021 be declared invalid!

Our goal with this appeal is to protect the future of human rights in New Zealander for everybody. Currently under the Covid-19 Public Health Response Act 2020, a small group of unelected individuals can mandate that whole sectors of people must be injected or lose their jobs if they deem it to be a public health measure. Unless the law is changed, Government overreach will increase and gain more power and control in the future.

You can be part of breaking the complacency by sharing the message. Be part of the awakening!"
