Lance vs Selwyn District Council - please help Lance and other hardworking Kiwis battling against local government, & the RMA 1991

Canterbury

Lance is my son who needs your help to pay over $22,500 in legal fees fighting the Selwyn District Council. We believe they acted inappropriately when they refused to acknowledge he lived on his rural property and was entitled to run a "permitted" home based business.

The nightmare started in Dec 21,when an abatement notice was issued which didn't allow for a home based business.Council refused to drop the notice or change it to one which would take into consideration that he lived on the property,so was therefore entitled to a home based business.

Attempts to reason with them,or arrange a meeting fell on deaf ears.

In Nov 22 enforcement orders via the RMA and the Environment Court were sought by council.

Part of those orders said he had 7 days to remove all vehicles from his property, except 2 for personal use,and remove any tools that could be associated with his business,or council had the right to remove them all and sell them.

He panicked and removed pretty much everything initially. Lance is a car spray painter, which ECAN said is a permissible activity.

They wanted to not only limit the number of vehicles, they wanted the orders to carry over to any future owners. They also wouldn't be able to operate a home based business, even though it's permitted.

Council has wasted about $40-$60,000 at a guess of rate payer money, and left my son mentally stressed, and worried about how to pay his legal bills.

For more info please see the declaration and council emails in the photos or facebook.

Funds raised will help Lance cover his legal costs, infringement fees, and all expenses incurred due to council. Excess funds to go towards legal costs for other Kiwi's or legitimate groups battling councils,or change around the Resource Management Act 1991

Update  16 April 2023

OIA request shows thousands wasted of rate payer money. Also costing Lance thousands in legal fees needlessly, to only end up being allowed to run a home based business as he was saying to council all along.
