Practically everything has been taken – my mum’s house and her property. 67 years old, now she has to start all over again with huge debt.
Auckland
Because of a family dispute, my mum has lost her home, and I lost my inheritance of $30,000.00 given to me by my father after he died of cancer when I was two years old.
My mum brought a property so she could build a house on it, along with a granny flat separate from the main dwelling for my grandparents to live in. Their health was getting worse, and she wanted to be close to them so she could drive my grandfather to Middlemore hospital three days a week for him to get dialysis.
Unfortunately, he died of bowel cancer, and that's when things got very messy.
Family issues arose leading to a court case, which unfortunately the judge ruled in their favour.
It took 6 months for the appeal court judges to come back with a decision, in which on every other aspect they agreed with the High Court judge’s decision. And instructed that my mum had to pay one set of court costs, the amount between $13,000 and $15,000.
Because I was constantly sick, in and out of hospital since the age of 9, I left my inheritance in the property.
Now, we are struggling to get our heads around everything, trying to find enough money to move house, and find another place to rent.
I cannot work as I have Fibromyalgia, Endometriosis, Blood clotting disorder, anxiety, and no large bowel, so I battle with a range of symptoms associated with that.
Just when we thought things couldn’t get any worse, the bank informed my mum that because this was a court order that she had to sell the property, she had to keep paying the mortgage even after she had to leave her home.
So, she not only has to pay rent at another house, she has to pay mortgage on the house she is not even allowed to live in anymore. Even though when the house sells, the bank will get their money back from her small percentage of the sale.
My mum is only on the NZ super, so paying rent and a mortgage is financially impossible.
Even though my mum gets a small percentage of the sale, with the mortgage and legal fees, my mum will be left with nothing. For someone in retirement, it is very difficult to start all over again with nothing.
To top it all off, my two Jack Russell dogs have had health problems for over a year, in which we have had to pay several thousand out to vets and Skin Specialists to get things right.
Any help and advice is greatly appreciated, any money left over will go towards our favourite charity - the SPCA. As we still would love to give to charity.
Thank you
I'm Jan's daughter. My mum has been there for me when I was sick in hospital for years and in a wheelchair, she was always there. My mum has always given to charities, and tried to help as many people as possible. Now, I feel it is her turn to be helped.
The use of funds will go towards paying the mortgage while renting, and towards the $13,000.00 for court fees.
She has all her legal fees that she has to pay back to legal aid, which is over $100,000.00.
