Rare and unique to Northland, ancient swamp kauri is a resource we cannot afford to lose.
Valuable wetlands are being destroyed in the mining of swamp kauri leading to polluted waterways and habitats laid to waste. That is why NEPS is applying to appeal the Court of Appeal's decision dismissing our claims about the level of protection provided to swamp kauri. In particular:
- What amounts to a finished product under the Forests Act and
- Whether swamp kauri is a protected New Zealand object under the Protected Objects' Act
We are concerned with the legal definition of a finished product as timber millers are currently exploiting a loophole by claiming that wet slabs of wood are finished table tops. Do you buy your furniture from a timber miller or a furniture company?
The swamp kauri industry is surrounded by controversy following the Marsden Point pipeline rupture, costing taxpayers untold sums of money, while no one is being held accountable. It is therefore in the public interest that the court hears our case.
