Not so fast, you Council and Panuku city slickers: We want a proper say before you mess with our peaceful beachside paradise!
Takapuna Residents’ Association is seeking a High Court review of Auckland Council’s decision to allow a large, publicly-owned open space, at the centre of its metropolitan centre, to be partially sold for private development. The site at 40 Anzac Street Takapuna is currently a car park and popular market venue.
The association contends there were serious flaws in the process that informed Council’s decision on the 10th of July and is asking whether Councillors had the proper facts in front of them to make a decision.
The application for judicial review in the High Court was made 25 September, 2019. Underwritten by members of the community, this action requires the Society to raise $21,000. The Society might expect Auckland Council to respond to this appeal later this year. If the Court grants the Society leave to appeal it might, at its discretion, set a hearing date sometime in 2020. The Society then expects to extend its total fundraising target for this particular action to $45,000.
This Givealittle page has been launched to support the legal appeal and the Society will be holding public fundraising events and have a stall at Takapuna Market, 40 Anzac Street, every Sunday morning to raise its membership.
The Society first formed in 2007 to promote the interests of residents and has been active ever since, taking an interest in all matters relating to good local government.

Agreement Reached 9 March 2020
In the light of an assurance by Auckland Council that it will instruct the Devonport-Takapuna Local Board and Panuku to include, where appropriate, the Takapuna Residents Association Incorporated in discussions of the future uses of the current carpark known as 40 Anzac Street, Takapuna, the association has agreed to discontinue its application to the High Court for a judicial review.
The review related to the decision by the Council’s Environment and Community Committee on 10 July 2018 to redevelop 40 Anzac Street as a new town square. The review, which had been set down for a hearing in the High Court at Auckland on Tuesday, 10 March will now not proceed.
“There are issues relating to the size and siting of new buildings proposed for erection on that currently open space, as well as possible accommodation of the popular Sunday market that are better being considered in constructive dialogue between all affected parties, the Council, Panuku, the local board and the community than argued in a Court of law,” said Terry Dunleavy, chairperson of the Residents Association. “Our association welcomes this opportunity now offered by Council for the concerns of our Takapuna community to be heard.”
