Green Bay East Residents Society (GBERS) is in the High Court challenging a non-notified resource consent for an 8 Unit, 3 storey development at 15 Cleve Road, Green Bay.
Why?
Council has not followed the Resource Management Act, its own Unitary Plan and has consented significant drainage work on neighbouring properties without notifying the owners.
The Resource Managment Act requires a resource consent application to be notified to neighbours if there is a minor effect. Council considers a developer constructing 30m of drainage, a new manhole and demolition of a garage on a neighbour’s property is a “less than minor” effect that can be granted consent without notification to the owners. Permanent change of the character of the street, building blocking sun to neighbouring properties is nonsense, could happen next to you, but what can individuals do to stop it?
This development is the first of its kind in the MHSZ in our area and is already being used by the Council to justify other non-notified consents.
GBERS urgently needs your help to challenge these decisions and ensure that the Council and their staff properly apply the Unitary Plan as this is their job that they are being paid for. The decisions were so poor Auckland Council did not defend them in the High Court, but also did not explain its consenting approach to this important issue of interpreting the infrastructure and servicing provisions of the Unitary Plan.
