I'm Ashleigh the Advocate, and I'm starting this Givealittle to provide a litigation "safety net" for a client who is being forced to wear a face covering, with threat of losing his employment.
SITUATION: His employer initially proposed that his employment would be terminated if he could not wear a face covering. Since applying to the Employment Relations Authority, he remains employed. However, he has now received a written warning, and must wear a 'face shield' as an interim measure. He must also produce a psychiatric report, and an antibody test (both paid by the employer). If my client cannot fulfil these conditions, he continues to risk termination of employment.

LITIGATION: His skills and qualifications are not readily transferrable, and he is motivated to remain in employment. He is a young father. If it was was simple as just wearing a mask, he would.
This is is only option.
His employer has said that, if he loses, they will seek that he repay their legal costs (as is standard in litigation).
This Givealittle is to be used for:
- Firstly, as a litigation safety net to protect him against the risk of paying their costs if there is a loss.
- Secondly, to cover all costs and disbursements associated with this litigation (including experts).
- Thirdly, to cover his legal fees.
- Fourthly, to assist him with his household expenses (if required).
- Lastly, to assist other litigants in the same situation.
I am his legal representative.
Protect against adverse costs, to pay costs, disbursements and legal fees, to assist him financially (if needed), and to assist other litigants in the same situation.
WE WON 15 July 2022
We won, and the employee is being reinstated to his role on an interim basis. While things aren't over, the Employment Relations Authority has held we have a "strongly arguable" case moving forward.
